Specific grounds of appeal for this contravention

 

1.) There have been many appeals upheld on red routes where a motorist contended that they were stopped where prohibited in order to read the signs. The signage on red routes is confusing and often missing or facing the wrong way or the sheer number of different types of restriction make it too confusing. If you have genuinely stopped in order to work out whether you can actually stop then your appeal should be upheld. It maybe that you were stopped near a sign?

2.) If the Penalty Charge Notice (PCN) was issued just before restrictions ended or just after they started by around 2 minutes your PCN maybe cancelled if the issuing authority cannot provide evidence that the traffic wardens time piece is accurate. See adjudicators case below. Also most enforcing authorities have a set of guidelines issued to their enforcement officers. Usually these would state what grace period there is at the beginning and end of a controlled period.
