This section deals with Penalty Charge Notice that are either handed to the driver or placed on the windscreen of a vehicle.

 

We set out below full details of each of these stages with samples of the documents used in each stage.

Stage 1.) Penalty Charge Notice Either handed to the driver or placed on the windscreen of the vehicle.

Stage 2.) Notice To Owner (NTO) – issued by post to the owner of the vehicle if the penalty charge Notice is not paid within 28 days (or informal representations made)

Stage 3.) Making Representations – formal representations can be made within 28 days from receipt of the notice to owner..

Stage 4.) Notice of Acceptance – if your representations are accepted.

Stage 5.) Notice of Rejection – if your representations are not accepted.

Stage 6.) Notice of Appeal –  the form sent out with a notice of rejection allowing you to appeal to the independent parking adjudicator

Stage 7) Charge Certificate – can be issued if you fail to pay the penalty charge notice 28 days after an enforcement notice or refusal of your informal representations or appeal.

Stage 8) Registration of Debt , order for Recovery, warrant of execution and witness statement (formerly a statutory declaration) – The debt can be registered at the traffic enforcement centre if you have not made payment within 14 days of the issue of a charge certificate. There are then recovery procedures available to an enforcing authority to follow including instructing of bailiffs.
